Changes to gas safety check legislation

For all new rental agreements after 29th March 2021, or when there is a fixed term agreement of over 5 years, rolls into a periodic tenancy agreement after 29th March 2021, rental providers must have gas safety checks completed for the rental property. The records of the gas safety checks must be kept, and be produced, upon request. 

It is compulsory for all gas installations and fittings must have a gas safety check performed by a licensed, or registered, gas fitter with Type A servicing accreditation every 2 years.

What rental gas safety checks are required?

When our licensed and certified gas fitters perform a gas safety inspection, we assess your property for:

  • Leak and pressure retention test on your main gas line
  • Negative pressure test to ensure there are no integrity issues
  • Check gas safety valves
  • Carbon monoxide testing
  • Safety and compliance to all gas safety legislation and regulations
  • Test your gas appliances
  • LPG cylinders (where present)

Documentation & proof of gas safety checks

To ensure the safe use of gas devices, our expert gas fitters provide gas safety checks according to the new legislation with proper administrative and quality-control documentation.

The documentation that we provide upon that completion of a gas safety check includes:

  • Full name of tester
  • Licence and registration details
  • Date gas check was performed
  • All results from testing
  • Details of repairs conducted
  • Any other actions taken

Each Type A gas appliance which is serviced must have a copy of the documentation of gas servicing work submitted to the VBA (Victorian Building Authority) and be supplied to the rental provider.

Gas safety check implications for rental providers

Landlords have a crucial responsibility to ensure the safety of your tenants through regular gas appliance checks. To maintain compliance, rental providers must conduct gas safety checks on all gas operated fixtures such as heaters, cooktops, water heaters and main gas lines at least every 2 years.

As a rental provider, it is your responsibility to ensure that a gas safety check has been performed by the appropriately licensed or certified gas fitter, within the past 2 years, before a new renter moves in. When we complete a gas safety inspection, our plumbers will provide you with a detailed report that you must keep and present before signing a rental agreement.

As a renter in Victoria, you can now actively ensure your gas safety and protection of the property that you reside in. All rental properties must have had a gas safety check within 2 years prior to occupancy, or have one arranged immediately upon moving in. To maintain these standards, Energy Safe Victoria recommends that checks be conducted every two years, giving renters peace of mind for the duration. Furthermore, tenants are able to request both the date of previous gas safety inspections as well as necessary documents whenever needed. 

If you are unsure when your rental property last had a gas safety check, rental providers are required by law to provide such information within 7 days from written requests.
